Overview of the Litigation and Settlement
A proposed class action settlement has been reached in the lawsuit styled Herman Ragland v. WorkSTEPS, Inc., Case No. CV-23-990443 (the "Lawsuit"), which is currently pending in the Cuyahoga Court of Common Pleas, located in Cleveland, Ohio (the "Court").
In the Lawsuit, the Plaintiff, Herman Ragland ("Mr. Ragland"), has asserted certain claims against WorkSTEPS, Inc. ("WorkSTEPS") arising out of his purchase of a CPAP machine from WorkSTEPS by making an initial down payment and three subsequent monthly payments. Mr. Ragland's claims were brought on his own behalf and also on behalf of all other individuals who purchased a CPAP machine from WorkSTEPS on the same terms between January 1, 2022, and December 31, 2024 (the "Settlement Class"). In the Lawsuit, Mr. Ragland and the plaintiff class are represented by Ronald I. Frederick with the law firm Frederick & Berler, LLC ("Class Counsel"), and WorkSTEPS is represented by Craig C. Dilger and Benjamin M. Fiechter with the law firm Stoll Keenon Ogden, PLLC ("WorkSTEPS' Counsel").
WorkSTEPS denies the claims in the Lawsuit, and the Court has not decided who is right or wrong. The parties have agreed to the settlement to avoid the expense, uncertainty, and risks associated with litigation. On April 22, 2026, the Court entered an order preliminary approving of the settlement and requiring that WorkSTEPS provide all members of the Settlement Class with notice regarding the proposed settlement. On August 11, 2026, the Court will determine whether to grant final approval of the settlement. If approved, the proposed settlement will resolve the Lawsuit and result in WorkSTEPS making a settlement payment to members of the Settlement Class who do not opt out of the settlement.
This Website is intended to supplement the Notice provided directly to members of the Settlement Class and to provide additional information regarding the Lawsuit, the proposed settlement, the process for objecting to and opting out of the settlement, important upcoming dates, and the contact information for the attorneys for Mr. Ragland and WorkSTEPS.
Current Status and Important Dates
On April 22, 2026, the Court entered an Order Granting Preliminary Approval of Settlement. Members of the Settlement Class have until Tuesday, July 21, 2026, to opt out of, or object to, the settlement. On August 11, 2026, the Court will conduct a Final Approval Hearing to determine whether the settlement will be given final approval.

Important Information Regarding Opting Out of the Proposed Settlement
Members of the Settlement Class may choose to opt out of the proposed settlement. If you are a member of the Settlement Class and want to opt out of the proposed settlement, you must send a written request for exclusion postmarked no later than Tuesday, July 21, 2026. The opt-out request must include the name of the Lawsuit, your full name, your current mailing address, and the words "OPT-OUT." The request to opt-out must be personally signed by you and include the statement: "I/we request to opt out and be excluded from the proposed class settlement in Herman Ragland v. WorkSTEPS, Inc., Case No. CV-23-990433. If you do not provide a timely and complete opt out request, you will lose the opportunity to exclude yourself from the Settlement Class and will be bound by the settlement.

Important Information Regarding Objecting to the Proposed Settlement or Class Counsel's Fee and Expenses Application
Members of the Settlement Class may choose to object to the proposed settlement and/or Class Counsel's application for fees and expenses. Class Counsel has not yet filed their application for fees and expenses but must do so on or before Tuesday, August 4, 2026. Once filed, a copy of the application will be available from this website. If you are a member of the Settlement Class and want to object to the proposed settlement and or Class Counsel's application for fees and expenses, you must send a written objection to the Court postmarked no later than Tuesday, July 21, 2026. The objection must include the name of the Lawsuit, your full name, your current mailing address and telephone number, a statement of the specific grounds for the objection, as well as any documents supporting the objection, the identity and contact information for any attorney representing you, a statement regarding whether you or your attorney intends to appear at the Final Approval Hearing on August 11, 2026, a statement identifying all class action settlements you have objected to in the previous five years, and your signature or the signature of your attorney. You do not have to attend the Final Approval Hearing to object, but if you do not provide a timely and complete written objection, you will lose the opportunity to object to the settlement.
